Here's what Ebay's BUYER PROTECTION page says (see very bottom regarding shipping it back):

What does eBay Buyer Protection cover?
eBay Buyer Protection covers items purchased on eBay with eligible payment methods that are not received or not as described in the listing. Some purchases are not covered, including prohibited or restricted items and items listed or that should be listed in the Motors (except for Parts and Accessories) and Real Estate categories. Most Business and Industrial categories are covered by eBay Buyer Protection. Remember, eBay Buyer Protection doesn't cover fraudulent charges or buyer remorse. Also, items must be purchased on the U.S. eBay.com website to qualify for eBay Buyer Protection coverage, and are covered for 45 days from the date of payment. Purchases made on Half.com and classified listings on eBay.com are not covered.

What happened to PayPal Buyer Protection?
PayPal Buyer Protection on eBay existed only for eBay customers who paid for their purchases through a PayPal account. Now purchase protection and issue resolution for your eBay purchases will be managed by eBay, for all eligible payment methods.

With eBay Buyer Protection, buyers will receive coverage for the purchase price of the item, plus original shipping. eBay Buyer Protection also introduces a new, streamlined process for customer service, so you can get help quickly either on the phone or online.

How does this program benefit sellers?
eBay Buyer Protection makes it easier for buyers and sellers to resolve issues with a new, streamlined process for customer assistance. We encourage buyers to work directly with sellers before opening a case because this is often the fastest and easiest way to resolve problems.

The new system also makes it easy for sellers to give their information to eBay. Sellers can always contact our customer support specialists to discuss their case 7 days a week, between 5:00 AM – 10:00 PM Pacific Standard Time (PST).

Do I need to send the item back to the seller?
If you have opened an item not as described case for a purchase covered by eBay Buyer Protection, then you must send the item back to the seller. You must also provide eBay with the shipping tracking number in order to receive a refund into your PayPal account.

Yeah, it SAYS that I will receive a refund, but it seems so backwards to me. Why would I trust that a guy that just ripped me off with fake dvds would actually refund my money AFTER I send him his fake dvds back? Ugggggg!!!! I dont know what to do!

I tried again with paypal and filing a claim and it just will not work. Just keeps shuffling me back to ebay.

Ebay is the one that will likely refund your money, not the seller..and according to a previous post from you, the seller has also agreed to refund your money. Ebay has this in writing, correct? As long as you have proof that you sent the item back, you should be fine.

That's what I was thinking. As long as you have proof you returned it (tracking #) then ebay is basically saying your covered. If the seller doesn't do it...then I think they/paypal will.

Yeah, i guess you are right. He has given me a PO BOX that I'm to send it to. It seems to me that I saw that you cannot get a tracking number when its sent to a po box. Hopefully I'm wrong. Ugg. TOTALLY NOT BUYING FROM EBAY EVER AGAIN!

1st step--contact seller and confront and request a COMPLETE refund. Give him/her a time frame. If they don't meet it, contact ebay (probably will want to report to ebay anyway).

If that doesn't work, contact paypal.

You'll get your $$ back.
Contact paypal first(refunds are faster if you paid that way).

I always go through Paypal 1st.

I just had a problem recently after I bought something off of Ebay and paid with Paypal.

After I put the complaint in with Paypal, the person offered to send me a new item, but I never received it. So, I excalated the claim and within that day, the seller refunded my money AND I gave him bad feedback.

I don't like to get the runaround.

Why would you follow through on this auction if there is suspicion that the DVD is fake? You can retract your bid.
